Публичная оферта

Настоящее пользовательское соглашение, далее «Соглашение», заключается между Интернет-магазином 366store, имеющим адрес в сети Интернет www.366store.ru, далее «Интернет-магазин» или «Сайт», и пользователем услуг Интернет-магазина, далее «Покупатель», и определяет условия приобретения товаров через Сайт.

1. Основные положения

1.1. Настоящее Соглашение заключается между Покупателем и Интернет-магазинов момент оформления заказа.

1.2. Настоящие Соглашение, а также информация о товаре, представленная на Сайте, являются публичной офертой в соответствии со ст.435 и ч.2 ст.437 ГК РФ.

1.3. К отношениям между Покупателем и Интернет-магазином применяются положения ГК РФ о продажи товаров дистанционным способом (ст.497 Федерального закона РФ от 25.10.2007 N 234-ФЗ), а также Закон РФ «О защите прав потребителей» от 07.02.1992 № 2300-1 и иные правовые акты, принятые в соответствии с ними.

1.4. Покупателем может быть любое физическое или юридическое лицо, способное принять и оплатить заказанный им товар в порядке и на условиях, установленных настоящим Соглашением, на территории Российской Федерации.

1.5. Интернет-магазин оставляет за собой право вносить изменения в настоящее Соглашение.

1.6. Настоящее Соглашение должно рассматриваться в том виде, как оно опубликовано на Сайте, и должно применяться и толковаться в соответствии с законодательством Российской Федерации.

2. Информация о товаре

2.1. Товар представлен на Сайте через фото-образцы, являющиеся собственностью Интернет-магазина.

2.2. Каждый фото-образец сопровождается текстовой информацией: ценой и описанием товара, информацией о сроках обработки товаров, информацией о предзаказе.

2.3. По просьбе Покупателя менеджер Интернет-магазина обязан предоставить посредством электронной почты прочую информацию, необходимую и достаточную, с точки зрения Покупателя, для принятия им решения о покупке товара.

2.4. Указанная на Сайте цена товара может быть изменена Интернет-магазином в одностороннем порядке.

3. Порядок приобретения товара

3.1. Покупатель вправе оформить заказ на любой товар, представленный на Сайте. Заказ может быть оформлен Покупателем следующим способом: самостоятельно на Сайте.

3.2. После оформления заказа в telegram Покупателя отправляется сообщение, подтверждающее принятие заказа, с указанием номера заказа, наименований выбранных товаров и общей суммы заказа, являющийся неотъемлемой частью настоящего Соглашения.

3.3 После упаковки и отправки заказа, в telegram Покупателя отправляется письмо, в котором указан трек-номер для отслеживания посылки, а именно “номер посылки”. По данному номеру, на сайте почты России, Покупатель имеет возможность отследить посылку.

3.4. При отсутствии товара Покупатель вправе заменить его другим товаром либо аннулировать заказ.

3.5. Покупатель вправе отказаться от заказанного товара в любое время до его отправки заблаговременно поставив в известность об этом Интернет-магазин посредством электронной почты.

4. Доставка и приемка-передача товара

4.1. Доставка товара, заказанного в Интернет-магазине, в согласованном количестве и ассортименте, осуществляется службой доставки CDEK по территории РФ.

Доставка международный отправлений осуществляется службой доставки CDEK до границы, после пересечения границы доставка осуществляется местной почтовой службой.

4.2. Расходы по доставке товара оплачиваются Покупателем по тарифам.

Тариф на международные отправления зависят от веса выбранных товаров.

4.4. Отправка и доставка заказанного товара производится в оговоренные с Покупателем сроки. Информация о сроках обработки и доставки товара указана в описании к товарам.

Уважаемый покупатель! Пожалуйста, проверяйте ваш telegram, указанный при оформлении заказа. Мы очень внимательно относимся к статусу вашего заказа и всегда высылаем вам сообщения в которых описан каждый этап формирования заказа.

Просим вас быть предельно внимательными приходящим от нас сообщения. В день отправки вашего заказа в telegram высылается трек-номер для отслеживания, после чего вы сможете отслеживать свою посылку на сайте CDEK в графе “отслеживание”.

Бывают случаи, когда посылка лежит 14-30 дней в вашем почтовом отделении, после чего она возвращается обратно к нам.

366store Shop не следит за статусом вашей посылки. Когда посылка прибудет к вам по указанному адресу, CDEK обязан передать вам извещение на получение посылки. В любом случае, даже если извещение к вам не пришло, а вы видите по трек-номеру, что ваша посылка находится в отделении по месту жительства, значит вы можете забрать посылку самостоятельно, без извещения.

5. Оплата товара

5.1. Используя систему СБП, вы моментально оплатите покупку электронными деньгами. Заказ будет автоматически оплачен и готов к отправке согласно пункта 3.2

5.2. Товар оплачивается только в рублях, при оплате с банковских карт, в другой валюте, платеж будет сконвертирован согласно курсу банка, выпустившего карту.

6. Возврат и обмен товара

6.1. Покупатель вправе отказаться от товара, если он еще не отправлен.

Покупатель вправе отказаться от товара после его получения в течение четырнадцати дней. Возврат товара надлежащего качества возможен в случае, если сохранены его товарный вид, потребительские свойства, а также документ, подтверждающий факт и условия покупки указанного товара (товарная накладная, кассовый чек). В течение этого периода Покупатель обязан известить менеджера магазина посредством электронной почты о желании вернуть товар.

6.2. При отказе Покупателя от товара до его отправки Интернет-магазин возвращает ему денежную сумму, уплаченную за товар.

При отказе Покупателя от товара, после его получения, Интернет-магазин возвращает ему денежную сумму, уплаченную за товар, за вычетом суммы расходов Интернет-магазина, связанных с доставкой товара Покупателю и вывозом товара от Покупателя, не позднее, чем через десять дней со дня предъявления Покупателем соответствующего требования.

6.4. Товар ненадлежащего качества может быть заменен на аналогичный товар надлежащего качества, либо возвращен Продавцу, в данном случае доставку товара оплачивает Продавец.

6.5 Покупатель вправе совершить обмен товара после его получения в течение четырнадцати дней. Обмен товара надлежащего качества возможен в случае, если сохранены его товарный вид, потребительские свойства, а также документ, подтверждающий факт и условия покупки указанного товара (товарная накладная, кассовый чек). В течение этого периода Покупатель обязан известить менеджера магазина посредством электронной почты о желании обменять товар. Расходы в данном случае оплачивает Покупатель.

7. Прочее

7.1. Интернет-магазин оставляет за собой право расширять и сокращать товарное предложение на Сайте, регулировать доступ к покупке любых товаров, а также приостанавливать или прекращать продажу любых товаров по своему собственному усмотрению.

7.2. Интернет-магазин вправе проводить специальные акции.

7.3. В соответствии с Федеральным законом «О персональных данных», размещая заказ, Вы даете согласие Интернет-магазину на обработку своих персональных данных.

7.4. Продавец обязуется соблюдать конфиденциальность в отношении персональных данных Покупателя, а также иной информации о Покупателе, ставшей известной Продавцу в связи с исполнением настоящего Соглашения, за исключением случаев, когда такая информация:является общедоступной; раскрыта по требованию или с разрешения Покупателя;

требует раскрытия по основаниям, предусмотренным законодательством, или при поступлении соответствующих запросов суда или уполномоченных государственных органов; раскрыта по иным основаниям, предусмотренным соглашением Сторон.

7.5. Продавец вправе в одностороннем порядке вносить изменения в Соглашение путем публикации изменений на Сайте по адресу www.366store.ru, если иное не предусмотрено новой редакцией Соглашения.

7.6. Соглашение является юридически обязывающим договором между Покупателем и Продавцом содержит правила совершения покупок в Интернет-магазине «366store».

7.7. Данный договор считается заключенным с момента выдачи продавцом покупателю кассового или товарного чека, либо иного документа, подтверждающего оплату товара, или с момента получения продавцом сообщения о намерении приобрести товар.

This user agreement, hereinafter the «Agreement», is concluded between the 366store online store, which has an Internet address www.366store.ru, hereinafter the «Online store» or «Site», and the user of the online store services, hereinafter the «Buyer», and determines the conditions for purchasing goods through the Site.

1. Basic provisions

1.1. This Agreement is concluded between the Buyer and online stores at the time of placing an order.

1.2. This Agreement, as well as information about the product presented on the Site, is a public offer in accordance with Article 435 and Part 2 of Article 437 of the Civil Code of the Russian Federation.

1.3. The provisions of the Civil Code of the Russian Federation on the sale of goods remotely apply to the relationship between the Buyer and the online store (Article 497 of the Federal Law of the Russian Federation of October 25, 2007 N 234-FZ), as well as the Law of the Russian Federation “On the Protection of Consumer Rights” of February 7, 1992 No. 2300 -1 and other legal acts adopted in accordance with them.

1.4. The buyer can be any individual or legal entity capable of accepting and paying for the goods ordered by him in the manner and under the conditions established by this Agreement on the territory of the Russian Federation.

1.5. The online store reserves the right to make changes to this Agreement.

1.6. This Agreement should be considered as published on the Site, and should be applied and interpreted in accordance with the laws of the Russian Federation.

2. Product information

2.1. The product is presented on the Site through photo samples, which are the property of the online store.

2.2. Each photo sample is accompanied by text information: price and description of the product, information about processing times for goods, information about pre-order.

2.3. At the Buyer’s request, the online store manager is obliged to provide via email other information necessary and sufficient, from the Buyer’s point of view, for him to make a decision to purchase the product.

2.4. The price of goods indicated on the Site can be changed by the online store unilaterally.

3. Procedure for purchasing goods

3.1. The Buyer has the right to place an order for any product presented on the Site. The order can be placed by the Buyer in the following way: independently on the Site.

3.2. After placing an order, a message is sent to the Buyer’s telegram confirming acceptance of the order, indicating the order number, names of selected goods and the total amount of the order, which is an integral part of this Agreement.

3.3 After packing and sending the order, a letter is sent to the Buyer’s telegram, which contains the track number for tracking the parcel, namely the “parcel number”. Using this number on the Russian Post website, the Buyer has the opportunity to track the parcel.

3.4. If a product is unavailable, the Buyer has the right to replace it with another product or cancel the order.

3.5. The buyer has the right to refuse the ordered goods at any time before it is dispatched by notifying the online store in advance via email.

4. Delivery and acceptance and transfer of goods

4.1. Delivery of goods ordered in the online store, in the agreed quantity and assortment, is carried out by the CDEK delivery service throughout the Russian Federation.

Delivery of international items is carried out by the CDEK delivery service to the border; after crossing the border, delivery is carried out by the local postal service.

4.2. The costs of delivery of goods are paid by the Buyer according to tariffs.

The tariff for international shipments depends on the weight of the selected goods.

4.4. Dispatch and delivery of the ordered goods is carried out within the time period agreed with the Buyer. Information about the processing and delivery times of goods is indicated in the description of the goods.

Dear buyer! Please check your telegram specified when placing an order. We are very attentive to the status of your order and always send you messages that describe each stage of order formation.

We ask you to be extremely attentive to the messages you receive from us. On the day your order is sent, a tracking number is sent via telegram, after which you will be able to track your parcel on the CDEK website in the “tracking” column.

There are cases when the parcel lies for 14-30 days at your post office, after which it is returned back to us.

366store Shop does not monitor the status of your parcel. When the parcel arrives at your specified address, CDEK is obliged to give you a notice to receive the parcel. In any case, even if you have not received a notification, but you see by the track number that your parcel is at the office at your place of residence, then you can pick up the parcel yourself, without notification.

5. Payment for goods

5.1. Using the SBP system, you will instantly pay for your purchase using electronic money. The order will be automatically paid and ready for shipment in accordance with clause 3.2

5.2. The goods are paid only in rubles; when paying with bank cards in another currency, the payment will be converted according to the exchange rate of the bank that issued the card.

6. Return and exchange of goods

6.1. The buyer has the right to refuse the goods if they have not yet been shipped.

The buyer has the right to refuse the goods after receiving them within fourteen days. Return of a product of proper quality is possible if its presentation, consumer properties, as well as a document confirming the fact and conditions of purchase of the specified product (delivery note, cash receipt) are preserved. During this period, the Buyer is obliged to notify the store manager via email of the desire to return the goods.

6.2. If the Buyer refuses the goods before they are shipped, the online store returns the amount of money paid for the goods.

If the Buyer refuses the goods, after receiving them, the online store returns to him the amount of money paid for the goods, minus the amount of expenses of the online store associated with the delivery of the goods to the Buyer and the removal of the goods from the Buyer, no later than ten days from the date presentation by the Buyer of the corresponding requirement.

6.4. A product of inadequate quality may be replaced with a similar product of proper quality, or returned to the Seller; in this case, the delivery of the goods is paid by the Seller.

6.5 The Buyer has the right to exchange the goods after receiving them within fourteen days. An exchange of goods of proper quality is possible if its presentation, consumer properties, as well as a document confirming the fact and conditions of purchase of the specified goods (delivery note, cash receipt) are preserved. During this period, the Buyer is obliged to notify the store manager via email of the desire to exchange the goods. The costs in this case are paid by the Buyer.

7. Other

7.1. The online store reserves the right to expand and reduce the product offering on the Site, regulate access to the purchase of any goods, as well as suspend or terminate the sale of any goods at its sole discretion.

7.2. The online store has the right to conduct special promotions.

7.3. In accordance with the Federal Law “On Personal Data,” by placing an order, you give your consent to the online store to process your personal data.

7.4. The Seller undertakes to maintain confidentiality with respect to the Buyer’s personal data, as well as other information about the Buyer that has become known to the Seller in connection with the execution of this Agreement, except in cases where such information: is publicly available; disclosed at the request or with the permission of the Buyer;

requires disclosure on the grounds provided for by law, or upon receipt of appropriate requests from the court or authorized government bodies; disclosed on other grounds provided for by agreement of the Parties.

7.5. The Seller has the right to unilaterally make changes to the Agreement by publishing changes on the Website at www.366store.ru, unless otherwise provided by the new edition of the Agreement.

7.6. The Agreement is a legally binding contract between the Buyer and the Seller and contains the rules for making purchases in the 366store online store.

7.7. This agreement is considered concluded from the moment the seller issues a cash or sales receipt, or other document confirming payment for the goods, to the buyer, or from the moment the seller receives a message about the intention to purchase the goods.
